I am a Soldier for 25 years. My wife and I were married, divorced and remarried after several years of divorce. We bought a house together while I was overseas and she used a POA to sign for me.  Of the 5 yrs we have been remarried I have been gone for the military ALL of the time and have been home a total of 6 months in 5 years. It was agreed to be $200K She Took $250K didn't tell me about it , Then didn't make 11 Mortgage payments that I was sending to here. I found out. It's funny she has NO NEW Clothes, Jewlery, or money in the bank she JUST BLEW IT. She said it's not stealing from me in a community property state. Now I want a Divorce because of theft and lies. Is it considered theft if I had no clue because of complete trust? I feel that she got her settlement up front. Or she can pay for the thing all herself, and I won't be out anything.

Can I be completly absolved of the house so that when she forcloses, which she will. I will not be sought after by the mortgage company, and my credit not affected? Can any thing be done to repair the screw up she has already done to my credit? ie letters to credit bureaus? legal assitance?

Can I Throw her out of the house before the Divorce is final if I am paying the entire Mortgage?

We are going to go through with this Div. while I am here in Iraq. but she will be the one coming to see you. But I need to know if I can be absolved of financial responsibility. What will it take in a divorce as I will agree to walk away as long as I get agreed upon furniture and no financial obligation to a thief?
