Respondent in Prison

Helping daughter with pro se dissolution in Snohomish County. Petition has been filed and served on Respondent, who is in Washington state prison. One of Respondent's contentions in his response is that the court should take no action on the petition until 120 days after his release (between 12/09 and 7/10) to give him time to get out, get a job and $ to pay an attorney, and attend court proceedings. My daughter wants to finalize this asap, well before his earliest release date. Can she just move forward even if Respondent is unable to hire counsel and attend the court proceedings? (No kids or property is involved).
